anadin Posted September 14, 2006 Report Posted September 14, 2006 Sorry for the confusion it was "sold as seen", (not "trade sale") no warranty given or implied. This was from a Ford dealer not some back street garage. Having spoken to Trading Standards, they say even though no warranty was given the goods must be fit for the use they are sold for, the car obviousley isnt, as the gearbox broke after only 9 days of purchase. This applies to anything you buy from a shop, dealer catalogue etc. ONLY if it is bought privately i.e from someones home does this rule not apply. It may be that i will not get all of the money back due to what they call betterment, i.e. gearbox is in a better state than it should be for its age but i should hope to get at least the majority of the money back. (he says fingers crossed). and the garage know this the cheating swines , they will play it cool and say take us to court , and you will have to be prepared for that , call their bluff :D , then name and shame them here after :o Quote

The bloke fixing the gearbox has done work for the garage for many years and say's they are pretty straight, so i will wait and see what their MD says next week when he is back from his holiday. I will let you know what happens. I am looking forward to seeing the car again, it will be like getting a new car all over again, but hopefully one that works. :D Quote

dipsomaniac Posted September 15, 2006 Report Posted September 15, 2006 this case proves just how difficult it is to make trading laws - there are too many potential factors involved. it also proves how useless warranties/insurance policies are. i think a reputable dealer would meet you at least half (if not all of the) way. GOOD LUCK. it is very low mileage for the gearbox to fail Quote
