Country Lane, Guy in Land Rover discovery stopped in passing place, just enough room to get by, just as i pull up my wing by the front of his car he swings out :rolleyes:

 

 

Then says its my fault, damage is on the front corner of his car on bumper and his indicator lens broken bumper pushed in a bit on front corner. No damage on my front bumper other than a scuff that the side of his motor done as it scraped along.

 

He said if i gave him twenty quid for indicator at first but then changed his mind

 

 

Don't know who insurance will put blame on??? ;)

hate it when that happens.

 

tonight i could have had a bump

 

fetching brother from his mates, and there was a car parked on the other side of the road, oncoming car looked as though it was going to give way to me, (LIKE SHE SHOULD HAVE), and i had almost got to the point of no return, and i always slow down a bit just incase the prick in the other car does what she did - and thats pull out, and missed me by a fraction! - if i hadn't of braked - she would have run in me, catching the front, drivers side of the car!

 

a BMW X5 - did that to me aswell a few months ago.

dave your damage doesnt look that bad...

 

worst case just replace the door and the wing..

I would source the bits on ebay (mo4 can help you do that :angry: ).. labour wouldnt be too much.. maybe 100 quid ? or you could do it yourself.

I used to work at sun alliance 15 years ago.. for accidents that ended with a car pointing into the side of another:

 

considering his front bumper was pushed in - it was his fault. ofcourse not withstanding normal driving conditions/rules etc...

 

if his bumper was scraped off and bent back - it meant you hit him.

 

the best advice is to stick to your guns and say it was his fault really.

 

but I'm a kid so wait for some more experienced ppl :blink:

Source the part you need...and pay yourself to fix.shows you how to do it on the TIS disc...think it does ..sure i saw it on my one when i was looking for summit else i never found! :angry:

 

If it were me..id do it myself...plus stick to your guns and tell exactly what happend.

Trouble is with insurance companies nowadays is that if you do not have any independant witnesses, they tend to go for knock for knock and you both lose out.

 

2 years ago my wife had another women driver just pull out in front, and into my wife's left wing on a dual carrigeway. The other women was very sorry and admitted it was her fault etc. etc. When my wife went to claim against her the insurance said it had to be knock for knock as there were no other witnesses.

I agree this will most likely end up knock for knock. There is always a witness, you just have to look hard enough.

Theorectical: What happens with a rear end shunt not near any junctions etc when there are no witnesses.

I think if it is a rear ender then the person who shunted you up the back end:huh: :( :blink: is at fault as they were to close to you in the first place ,but having said that you would be better off with a witness :blink:

as far as i am aware if someone hits the back of your car then they are liable regardless, they should be of a safe enough distance behind you to be able to react and stop in time, if they are not then tough!!!

 

of course the other driver will always try and blame you in some way, but its their fault end-of!!

Seriously though, my sister was held only 25% to blame when she ran into the back of someone who stopped at a green light. Your not automatically to blame.

From your description, it almost seems that he did it on purpose. Does that seem possible?.

 

I always try to keep camera in the car. I've only had to use it once in 40 years and it certainly stopped any argument.

 

It may be worth getting stuck in on this, he may have previous.. or no insurance.

 

He who is most bloody minded usually wins these days. :D

Not all Land Rover drivers are like that.

 

I too own not only a Galaxy but a Landrover Discovery also a GT6 and a Mondeo and an Astra and a Mini Cooper S and...........ok so I cant ever sell a car maybe I do have a problem,

Sorry mate. we all seem only to notice the bad ones. However, it's a sad fact that the bloody minded, don't give a damn, type drivers do tend to take refuge in off roaders so it's too easy to relate the cars to that sort of driver rather than the other way round... er.. or do I mean that the other way round ;) ;) :lol:

 

I seem to have your problem. we've still got 2 Galaxies and a Picasso and only recently let go a Merc 180 with all the spoilers etc - but no fluffy dice.

 

It's very difficult to get rid of a faithful servant which costs next to nowt to run.

I know a bit of what neils like..when hes not working or buying cars, hes working on various cars aswell!!!.He has a very busy life!!(and he still finds the time to answer calls of help from little old me! ;) )

It's for incidents like these that I always go for cpmprehensive insurance cover. If the other vehicle was stationary but then moved off as you were passing it, then they will be at fault....but they may change their story to the insurance co - hope you notified your insurance co as soon as possible by phone, then back it up in writing. If the other party changes their story then it is clear that it contradicts your original report. Trouble is, as we have found out with my wife's insurers, the insurance co clerks may be too lazy to pursue the claim saying it was the other arty's fault - they could just settle for an easy life and tell you that it has to be settled knock-for-knock in the absence of independent witnesses. Good luck - I hope that the truth will be taken into account and you will "win".
