Have owned four Galaxies since N registration (whenever that was):

 

1. 45k, original clutch (3 years)

2. 45K. original clutch (3 years)

3. 20K, original clutch (a year) (got made redundant... :-( )

4. 60K, original clutch (2001 2.3) (nearly two years- bought it second hand at 25K miles)

Johnb80 could you drop me an email, i did send a message yesterday direct although not sure if you received it - would like to take up offer of advice on best process to proceed with small claims?

 

Fords contacted me again today confirming again that they would not pay, they had a duplicate copy from one of the letters i had sent! Was told that wear and tear would be caused through bad driving habits!!! i was livid.. i suggested that if my wife and i drove improperly why does our mondeo have 75000 miles on the same clutch and neither of us have had a clutch fail in 20 years driving each? received continual text book customer service responses. Was told that they have to be guided by the technicians diagnosis when the part was changed......although the same dealer/ technician advised two days prior to the repair that the clutch was fine and there was no problems with it, leaving me to risk a 600 mile drive back to the UK , (feeling = head + banging + brick wall!)

 

I am amazed how they have the gall to say 'thank you for your time today etc' after they have really P'd you off!! so very patronising!!

Okay, small claims court, a few obvious points really you must catalogue and document the events from start to finish, copies of receipts, reports etc crucial. The one thing I havent asked is where did you buy the car from and have you had it from new? The way the law works is that you take action against the retailler who will pass it on to Ford. It is for the retailer to prove that the goods were not faulty rather than you to prove they were, so simply asking them to explain how a clutch can fail so early if it wasn't faulty should leave them high and dry. When / if you go to court, the case is normally heard by a magistrate in the chambers at the back of the court, you all sit round a conference table so it's not as intimidating as going into a full court. You (the plaintiff) will be given chance to give the full story, the otherside (defendant will give theirs) you can question each other and the judge may ask a few questions before making his decision.

 

You can do all of this online to start the ball rolling, I prefer to do it by post to the court for the supporting documentation. Details of how to make a claim and fees etc can be found here. It does sometimes look like a lot of bother, it's not, the court service is very helpfull and when you leave court having won you feel great.

 

What you need to do now is:-

1) Send them a recorded delivery letter giving them 7 days to settle and warn them about court etc.

2) If they ignore that then send another stating that you are forwarding papers to the court

3) Send the papers to the court and enjoy your day.

Sharan TDI with 128,000 with no documentation for the clutch having been done.

However my works Transit Connect with 11,000 has just had to have a new clutch put in, and the company had to pay for it as "it is not covered under the term of warranty" a load of BS if you ask me. There have been a few of the new Connects, in my work that have had slipping clutches.

04 Galaxy TDI 30k on my clutch so far.

 

If you bought the car from a ford dealership then you need to go back to them and ask them to pay for the repair. Ask for a full refund first if you get no joy then ask for % I would personally ask for 80%.

 

If you still get no joy write a letter to the dealer detailing your claim and indicate that if you cannot reach an agreement that you will pursue the matter through the small claims court. You should point the dealer to the Sale of Goods act which states that all goods sold should be fit for purpose. You have a strong case that the vehicle they supplied was faulty. Indicate a date when if you have not resolved the matter to your satisfaction you will proceed to the small claims court. If the dealer does not respond positively lodge a claim with http://www.moneyclaim.gov.uk it only takes ten minutes and will cost you around
