I'm no lawyer (engineer, for my sins) but if they (Scorpion) Offer to provide a service for a given price (Consideration) and you Accept that Offer, a Contract is formed between you. No matter that it is verbal, it is still enforceable in law, although it is rather easier to prove your case if it is written down. If they then change the price, it has to be a breach of contract. This is not criminal, as contract law is part of the civil law. So you can't get the police onto them, you have to sue them yourself. On the plus side, though, the burden of proof is not so difficult in a civil case. The prosecution in a criminal case have to prove their case 'beyond reasonable doubt'. but in a civil case the burden of proof is only on a 'balance of probabilities', which means you can win your case if your version of events seems the slightly more likely of the 2 stories. As I say, this is just my opinion, I'm not qualified to give legal advice, but I would suggest you talk to a solicitor who is. Quote
mumof4 Posted February 6, 2006 Author Report Posted February 6, 2006 All we want is for them to pay for the cleaning of the seat and the distress caused to me.ok, so a ford galaxy doesnt have a lot of boot space.But there is enough room for tyre if it is upright.They could have done this.instead they elected to chuck it onto a seat.I am newly diagnosed asthmatic so dont as yet know everything that can trigger it off.But i do know that pushing the car in -2 degrees(which is what it was on thurs aft)does set it off combined with being furious at being fleeced!My local garage down the road has looked at the car and has quoted us Quote
mumof4 Posted February 7, 2006 Author Report Posted February 7, 2006 Got a phone call this morn from the garage that originally had the car saying that the letter was a pack of lies and that the tyre was an oversight!he claims that HE told me that the car was not being looked at till the thurs...nope..was your secretary i am afraid that told me the car was going to be ready on the wednesday...he claims he came down to help us push the car...when???....i never saw him neither did my instructer...Claims i never had an asthma attack...yes i did.said he'll sue us if we try to sue him, for a dishonest claim....go ahead..said that it was obvious that we couldnt afford to get the car fixed so just wanted the money back! :) as for the condition of the seat he said that it was a family car and wasnt clean anyway!(maybe...but they dont put oil/grease on the ruddy seats!) the seat they put it on was the one we put the car seat on...took the thing out be it went to the garagesaid ythat he personally washed and polished the car.....i laughed on the phone.i washed it on the sun and it came back filthy on the thurs eve.so....he has offered to bung us Quote

Keep in mind the rule of three - it takes three letters to show you're serious; most people give up after two! Do you know any other customers? Continue to be polite and reasonable, and like you've done for us, keep what is called a "contemporaneous note" of what he says if he phones rather than writing! Good luck Quote
