wjfe Posted August 16, 2005 Report Posted August 16, 2005 Hi Bit of a weird query here. I bought my new (04) Galaxy from a ford main dealer, via thier internal stock list. The car was sold to me as immaculate condition, with no accident damage or dents. I paid top book price for it, as it was described 'as new'. (TDI Ghia, 115ps, Versitility pack, 1300miles Quote
Masked Marauder Posted August 16, 2005 Report Posted August 16, 2005 Clearly mis-described. Your ultimate right is to reject the goods, however you could be expected to take a reduction for wear and tear as they are now not in the exact condition you bought. How serious are the other problems? Chances are this car was damaged in transit or in the workshops, thats assuming it has only the garage regisered as a keeper and no mileage to speak of. Quote
wjfe Posted August 17, 2005 Author Report Posted August 17, 2005 Thanks for that MM. I realise i probably don't have the right to reject the car and ask for refund. The other faults are minor but niggly. 1. headlining dropping at back2. versitility pack missing although was part of the sale (there are marks on the fabric as though a load cover has been in use)3. Curbed wheel4. some sort of paint spatter on steering wheel5. Creaking headlining and drivers side interior trim. Although the car was a year old, it was described as immaculate condition with no accident damage. Fords saw the car yesterday and admitted that the two panels had been resprayed, but they do not know why. and are willing to respray them to match the car. I told them that i would not have bought the car with the damage (I bought it blind from thier ford direct scheme), and would like it replaced a different car (same model etc). They are thinking about it. What i'm now trying to do is work out what sort of reduction in the purchase price I can ask if they refuse to replace the car. Any Ideas???? Cheers Bill Quote
johnb80 Posted August 17, 2005 Report Posted August 17, 2005 You have every ground you need to reject the car, I would tell them in no uncertain terms that you do not want this car, get them to loan you a car until they find an acceptable replacement. Get in touch with trading standards and that will help them focus on helping you.Do not be intimidated by them, not sure how it happened etc etc is totally irrelevant, it HAS happened, they now have to sort it out and there's no reason why you should suffer any loss or hassle through someone elses incompetence. [RANT MODE OFF] Regards - JB Quote
wjfe Posted August 18, 2005 Author Report Posted August 18, 2005 Thanks for that reply JB, I did a bit of digging around, the car was originally supplied from Little hampton on the south coast and sold to someone who lives in cleveland (up north?) I spoke to the previous keepers Mum, who claimed that her son had never had a Galaxy, and anyway he's been in germany for the past four years serving in the British Army? I looked a bit closer at the dealers stamp on the service history a little closer, and yes you've guessed it, it was serviced in Germany. Fords have agreed to supply me with a replacement vehicle, but it 'might take some time to locate one'. so i'm writing to them today to confirm this offer, and ask for a courtesy car. Oh, and one thing i did forget to mention..... I am a Trading Standards Officer... Although Fords don't know this yet. Cheers Bill Quote
buford_t_justice Posted August 18, 2005 Report Posted August 18, 2005 I bought my Galaxy through the Ford Direct scheme nearly a year ago now. Under the T&Cs of this scheme you have upto 30 days or 1000miles to return your car for ANY reason whatsoever and receive another car (subject to paying any balance difference if applicable) This Army guy has just taken advantage of the tax savings that can be had when buying a car and pocketing the difference when selling back in the UK There are plenty of damage free Galaxy's out there so unless you get a substantial discount I would get rid and get another. As for taking some time to get one this is a load of crap. Just look on the Ford Direct website and find the car you and tell him to get it. Shouldn't take him more than two weeks to get it. HTH.
