.... so the story ends ... sort of... ;)

Well, a lot of the faults have, I presume, now been fixed (i.e. speedo, brakes, airbag etc). However the corrosion around handbrake (is it that bad or just a bit of rusty staining on substantial metal?) and the garden hose a/c repair (unknown hidden damage and piss poor diy neglect/servicing) are probably enough for me to say no.....look for another.

Some other poor sap will be joining us in a few weeks time asking about how he can get his a/c working etc on his new motor! ^_^

For those of you who have been following the saga of my car I picked up an absolutley smashin 03 plate tdi Ghia this evening. 65000 (circa) miles, full dealership stamps and all electrics work (barring the temperature on the AC which seems to be reading wrong by about 40 degrees, did wonder if it was set to Farenheit but the sums don't add up ).

Anyway its smashing so fingers crossed .....will post piccies soon...

Do you ever get the feeling that someone somewhere really has it in for you? , maybe I smashed a mirror recently or stepped on a black cat!......

Wednesday night ( 2 days before going on a day trip to France )... turned right at a set of lights... bang... ( no not another car ) ... gearbox gone ... warranty only covers up to

If you were a woman, I'd say you were the type salesmen can see coming from a mile away.

Gee...what can I say? Bad bad luck. :(

Somewhat backs my theory that a significant proportion of 2nd hand vehicles have known underlying problems and thats why thet get shut pronto.

Hence my reluctance refusal to buy a 2nd hand car.

Judging from this forum, the majority of owners love their cars and dont grow bored with them or outgrow them. Only ones that seem to jump ship are the ones with the problem pups.

just wondered if its the drive shafts that have gone rather then the gearbox???????

Aren't all sales from garages/traders covered by a 3 month warranty under consumer law?

Deeply suspicious that a gearbox should go like that.

Could have been another "chipped" car.

Yes and this is ( though the warranty is 3rd Party and I'm still waiting to see how much they'll cough up ). However I do feel that this is more a case of bad luck than anything as the car has an unblemished service and MOT history.

:(

TBH given the rest of the car is pretty much A1 I'm fairly relaxed about, that and I have got to the stage now where I just need the car! and can't be arsed to go through all the rigmoral of legalese :D

btw what do you mean by "chipped"?

I mean remapped, tuned etc to get massive increases in power and torque. A lot of people do this with VW diesels as it is very easy and quite cheap. A lot also dont tell their insurance, garage or subsequent owners and quietly restore them to standard after 3 years or when something starts going wrong (e.g. mysterious overheating) and get shut.

The massive torque often exceeds the transmission rating.

But maybe I being too harsh on people? :(

By "warranty" I mean the dealer/trader is under obligation to supply goods of a merchantable quality under the consumer protection act. This has special meaning when it comes to second hand cars. It basically means that if your engine drops out or blows up the week after you bought it, then whoever sold the car is under some obligation to either fix it or refund you in full. Unless he can prove the fault was yours.

Third party insurance is not relevant.

If a vehicle has a fault within 6 months of purchase ( from a trader ) you can demand a repair from them.

It is up to the trader to prove that the fault did not exist at time of purchase, otherwise they are obliged to either repair/replace refund etc.

This is legally binding under the sale of goods act ( as amended ).

May not apply to consumable items, exhausts, tyres etc.

ie. they should be able to show you some kind of test/report on the gearbox which took place before sale.

Trading Standards should be your first port of call if they refuse.

Any warranty they give is in addition to these rights not instead of them.

iirc if its under the 28 day rules,of sale of goods act you can reject the car or make the dealer pay for the whole lot.

and as big kev has said trading standards are 1st port of call.
