Guest m8internet Posted April 21, 2004 Report Posted April 21, 2004 I've just changed from Vauxhall to Ford, replacing my Vectra with a MondeoI always buy a "nearly new" car that is no more than 12 months old, just shy of its first service My Mondeo was not exhibiting any faults on the day I bought it, but the list of faults is growing by every day...My local Ford dealer is refusing to entertain any warranty claims (claiming I have to call their admin centre, blah, blah), so I am using the same agent that sold me the car, which luckily is only a further 3 miles and also a Ford dealer However, the car has been with them on no less than 4 occasions, and ony one of the faults has been attended to, but sadly another fault appeared in its place!The car was put in with 9564 miles, and returned with 10 miles, and they refuse to correct THEIR mistake! Here is the list of faults, and I seem to find a new one each day :steering / braking, pulling to nearsideon first visit swapped tyres diagonally, front - rearon second and third visits checked and adjusted 4 wheel alignmenton fourth visit conducted road test, no fault found, but conducted a further road test and agreed the car was pulling to left when shown what was actually happening! SONY CD player (as per fitted to the Mondeo Ghia)the lights flicker when the headlights are on, but usually only after the car has been running for about 20 minutesdealer was unable to witness this fault on each visit mileometertrip computer button not resettingreplaced, but mileage was not reset (now incorrect)varius other faults in the display now presentthe unit also now bleeps at 70mph, and switches on/off at every 0.1 miles cruise controlnot very stableonce set the engine continues to accelerate, requiring it to be reset, waiting until the speed falls then set againonce set again, the speed can vary by up to +/- 15mphwhen set to 70mph, the bleep (see above) sounds appox every 20 seconds as the speed varies, even on a road that is totally flat! rear passenger door2 weeks ago this door was damaged by the front passenger doora replacement door has been ordered by the dealer Curious...The Ghia is supposed to have "lowered" suspensionI've compared mine to other models in the range, with 16" wheels, and I can clearly see an ENORMOUS gap between the top of the tyres and bodywork, such that from a distance the shocks can clearly be seen (front and rear), yet when I look at other models in the range they appear lower, even when they also have 16" wheelsWhy?The dealer is adamant the car has the correct suspension fitted Quote
HJT Posted April 21, 2004 Report Posted April 21, 2004 The Sale of Goods and Services Act states that goods should be of a merchantable quality and fit for the purpose for which they are sold. Your car clearly is not. I would state in writing that you will give them one more chance to correct all the faults, if this is not done then you will reject the car and demand a full refund. Richmond Posted April 21, 2004 Report Posted April 21, 2004 There was an English court decision a few years ago which decided that a string of faults in a new car did not require that it be replaced or the unfortunate owner be refunded, despite the Sale of Goods Act. The interpretation of 'merchantable quality' and 'fit for the purpose' (or whatever the law says) was very narrow and makes it very difficult to achieve a refund or a replacement. No harm in trying, 'though. Quote
