commandomark Posted December 5, 2008 Report Posted December 5, 2008 Hi I returned home today to find a letter from the police. I was caught speeding and i remember the time it happened, i thought it was a 40 untill i saw the camera van then realised it was a 30. This is on the NIP form i got sent and I just would like to find out what this means - " contrary to s81 (1) & 89 (1) rtra 84 sch 2 rtoa 88 " I was doing 36 in a 30 zone. Before you all go mad about running kids and old ladies over, it was on a dual carriageway, completely fenced off part of road with no turnings and i did genuinly belive it was a 40 zone. But i was still speeding, no one else to blame. I do alot of driving for my job,40k miles a year, and have never been stopped before. I've been driving for eight years. Not going to contest it or anything but i just wanted to know what is going to happen to me. Many thanks Mark Quote

tiny Posted December 5, 2008 Report Posted December 5, 2008 Not going to contest it or anything but i just wanted to know what is going to happen to me. Surely it tells you on the notice that you received exactly what the penalty is? Quote
commandomark Posted December 5, 2008 Author Report Posted December 5, 2008 Thanks for your replies! All i got sent was a NIP, a Notice of Intended Prosecution. There is no mention of the fine or any points.I have to fill that out and send it back stating that i was the driver at the time. They will then send me the details of what will happen. Most likely a Quote
Tekman Posted December 5, 2008 Report Posted December 5, 2008 Sound`s like its just to verify that you was the driver of the vehicle or have you had one asking if you where the driver or was someone else using your car at the time of the offence. The one that comes is later to say they want your DNA finger prints and stool sample. Kind regards Alan Quote
big_kev Posted December 5, 2008 Report Posted December 5, 2008 For a small fee ( going rate is around Quote
commandomark Posted December 6, 2008 Author Report Posted December 6, 2008 I'm fairly certain my wife was driving that day ^_^ Quote
Mirez Posted December 8, 2008 Report Posted December 8, 2008 You send the NIP back which basically states you were the driver at the time, they'll then send you another letter indicating what they intend to do. 36 in a 30 is low as far as they are concerned so they almost certainly wont take you to court over it (unless there is some other factor) and they'll 'offer' you Quote
Mirez Posted December 8, 2008 Report Posted December 8, 2008 (edited) Oh and be carefull if you go down the "my wife was driving" route, nearly all the scamera vans take two photos - one of the speeding offence and one zoomed in to show the drivers face. You could be done for contempt, perverting the course or something else of which the legal name escapes me. All have more serious consequences then 3 points / Edited December 8, 2008 by Mirez Quote
commandomark Posted December 8, 2008 Author Report Posted December 8, 2008 Cheers for the reply Mirez. Was only joking about the wife thing. I was in my work vehicle at the time. Quote
Bigjeeze Posted December 8, 2008 Report Posted December 8, 2008 I had a NIP for doing 36 in a 30mph - I got the option of attending a half day course at Police HQ at a cost of Quote

familyman Posted December 9, 2008 Report Posted December 9, 2008 As you were only 6 mph over you may get the option of the speed awareness course, mine cost Quote
commandomark Posted December 20, 2008 Author Report Posted December 20, 2008 If i get the option of doing the course i will jump at it. I do alot of driving for my job and it's sod's law once i get three points they'll clock up. I am so much more carefull now when driving about though. On the motorways rather than going full whack in the fast last i just trundle along at 65. Time is money but time is no use when your dead. One of my collegues died in an accident two weeks ago in his work van. That has made me think about driving even more carefully as well. Poor guy was only 27, hit a fence and from what i've heard something came through the windscreen and killed him. If it hadn't been for that he would of walked away from it with a earfull for crashing his van from our boss. Makes you think though. Quote
jkspoff Posted December 25, 2008 Report Posted December 25, 2008 You always have the option of discussing your case at a magistrates court instead of the fixed penalty and fine. Quote
