Tekman Posted November 21, 2008 Report Posted November 21, 2008 (edited) I bought a Galaxy 2ltr automatic now the deal was done I part exchanged my mondeo 2ltr auto plus cash for theGalaxy. we knew that it wasnt in A1 one condition and it wanted some work doing we didnt mine that we have had it a total of 6weeks now and one of them its been in a garage for repair done to the gearbox which as had complete strip down and all the mechanical gears have had to be changed at a cost of Edited November 21, 2008 by Tekman Quote

You have a legal right to expect a second hand car to be fit for its purpose and of a reasonable quality bearing in mind its age and condition. You cannot make a claim for faults that are caused by general wear and tear or are expected in a car of a certain age and mileage. Check website forums and the Internet for information about cars of the same make and age as your car. This can help you identify whether the problem is as a result of a manufacturing defect or just old age. You can make a claim for problems that are unexpected, or if your car is a relatively new one, caused as a result of a manufacturing defect. Depending on the severity of the fault, you can look to reject the car and request your money back or seek a repair at no cost to yourself. If you have bought a car from a trader and it develops a problem soon after purchase, your first step is to contact the trader and ask them to rectify the fault. If they will not take the car back or offer a repair, put your complaints in writing and send the letter by recorded delivery, giving the trader 14 days to reply. If the car has a major fault, or you are concerned about the mileage being incorrect, stop using the car. Continued use of a car that you are looking to reject, will lead to you accepting the car and affect your legal right to ask for your money back. If the trader refuses to discuss the matter with you, obtain an independent report on the car. These are available from the AA or RAC. A report from another garage is generally not considered to be independent. Send a copy of the report to the trader and give them a further 10 days to rectify the matter or advise them that you will consider taking legal action to rectify the problem if there is no response. Consider approaching a trade association such as the Retail Motor Industry Federation (RMIF) to mediate on your complaint before taking any court action. Quote

Tekman Posted December 12, 2008 Author Report Posted December 12, 2008 I phoned the dealer who is 45 miles from us and didnt get any reply`s. so next step I had the car evaluated by other garages close to me and asked the cheaper to go ahead and repair it when they dissmantled it the damage was exessive and thanks to there help it didnt cost me any more but it could have cost me at least Quote

So being a obedient husband and as santa is coming soon, then court it will be on monday going to find out about taking him to court never done this before so will go to small claims and ask them. Tekman Posted December 13, 2008 Author Report Posted December 13, 2008 'Tekman' date='Dec 13 2008, 10:51:22' Update just had phone coversation with owner of company I told him that after I had made over a dozen calls to no avail I sent the letters he didnt reply he as sayed he sent a letter "ye right" I told him after checking bt phone bill it shows that i did phone him I also told him that I got told by is staff that it was out of warranty and he wouldnt do anything. he stated that he only as 2 staff and none of them got any calls when I corrected him on is location and the salesman he admitted there was a temp person, I told him if he was to talk to me we would come to a agreement wich he agreed to it stands if I had returned the car he would have replaced the gearbox totaly wich eplained if he had got a gearbox I would have fitted it myself so he agreed to find out what it would cost for purchase of box fitting and vat and he will pay that amount I agreed to this due to its what would have happened anyway. but I have contacted gearbox companys lowest price I got for replace was Quote

gregers Posted December 14, 2008 Report Posted December 14, 2008 well alan,as it stood before you were given any info on here about what you could do,you at first thought you were going to be out of pocket for the whole amount,so calling his bluff(rightly or wrongly)you might get an increase in the amount he has offered you,this might be worth having a chat with consumer direct to see what they could advise,or you could think that 500 quid is better then a poke in the eye and put it down to experience?only you m8 can make that decision. I have allways been the one to accept what I was given, never pushed a issue due to me thinking I should have known better. But thanks to you and others I am begining to see that I should stand up for what is right, The dealer should bare some reponsabilty for what as happened if he rings will push the issue if he doesnt ring then will go to court site to go to next step. Tekman Posted December 15, 2008 Author Report Posted December 15, 2008 Update, Had a talk with the dealer he as checked to see what it would cost him if I had returned the vehicle to him, when the problem first appeared which I told him bt records showed I did phone him and was told by his staff that it wasnt covered under warranty. So after a good chat, He as verbaly agreed to meet the cost of half which I agreed was fare "now no laughing" he is going away tomorrow so if I take in a copy of the invoice from gearbox company then is secratary is supposed to give me a cheque for Quote
gregers Posted December 15, 2008 Report Posted December 15, 2008 mmmmmm WHY CAN HE NOT MAKE THE CHEQUE OUT FOR THE WHOLE AMOUNT YOU BOTH HAVE AGREED ON?????????????might be worth getting him to sign a bit of paper agreeing that this is just an interim payment of the whole amount that is owed to you,and dont be fobbed off by him saying times are tough,remember you had to find your hard earned to pay for the repairs to start with!!!!!but again this is only my opinion,if your happy with the situation then good luck and well done. Drove to dealers and whent into office seceratry sat there boss left for holodays gave her copy of invoice now she took 1hr 30 mins to check to see if the company was legal and tax regesterd I did in end have to tell here her how to do it. See then gave me a very nice cheque with everything to the penny I:E Quote
