Tekman Posted November 25, 2008 Author Report Posted November 25, 2008 Yep so right I am in a way a bit luck as Mine as the AG4 vw built box with a built in level indicator in the sump and refill system for filling not like the ranault we owned that was totally sealed. It seems manufacturers dont build to last they want it back to replace it not fix it. I tryed the dealer like banging your head against wall. I really do like this car so once the box is fixed then it will be the small things that I know about and was happy to fix that I will tackle. so as wiseman once sayed "lesson learned" With Kind Regards Alan Quote
gregers Posted November 25, 2008 Report Posted November 25, 2008 Its all under warranty anyway thank god but the car dealer is another problem contacted him yep the gray area came in as well it was ok when you bought it and your warranty as just ran out only had it 6 weeks we only give 28 day warrantys with our cars. mmmmmm think you might want to check sale of goods act,cant remember who it is you need to contact,but i seem to remember that under the sale of goods act you have 28 days to reject the car or report all faults that you come across to the dealer,and im sure any dealer has to give a minimum of 3 mths warrenty with any car sold,again check this out to make sure, check this out,especially where it states "Reversed Burden of Proof"http://www.consumeractiongroup.co.uk/forum...act-buying.html hope this is of help. I contacted Consumer direct after making a case file they advised me that it a very hard thing to prove however the car should be fit for use a nd it did less than a thousand miles so under the sales and goods act 1997 then have a burden to prove it wasnt there however it would be difficult so I phoned dealer and after speaking to boss I told him the cost which he was shocked. We came to a agreement that if he met me half way as its a 1995 and done 82000 miles and I cannot blame the company as this can happen to anyone, so he wants a photocopy of invoice and we will take it from there. Yep it had to go back due to a fault with the load lock solenoid wich was sorted and drives great now. Thank you every one. with kind regards Alan Quote
gregers Posted November 26, 2008 Report Posted November 26, 2008 mmmm what did consumer direct actually say to you about it,i:e do you have a strong case?coz id still be unhappy about even having to cough up half the amount(but thats me).if the law is on your side I WOULD NOT FEEL SORRY FOR THE DEALER AT ALL,just think of all the other peeps who have been fobbed off by him,its amazing with a little knowledge how they buckle in the end when you have the law on your side,but if your happy with what he has offered(potentially)then thats the main thing,if he wont budge on extending the offer see if he will up grade and lengthen the warranty you have with him.dont ask dont get :rolleyes: . glad to of helped in a small way,which is what this forum is all about. Tekman Posted November 28, 2008 Author Report Posted November 28, 2008 When I talked to them they told me that trying to make a case would be hard due to the age of the car, however the car still has to be fit for purpuse, had a word with gearbox company and he sayed that its hard to put a time limit on howlong its been bad but he did say that in his oppion the dealer as to step upto plate. Whent yesterday to dealer in person me 6ft.2"" ex-military and not tubby neather and for backup took wife 5ft.1/2" canadian when we got there he wasnt in so gave the assistant a copy of the bill with a letter telling him to contact me asap. consumer direct told me because I amtying to meet him half way if dealer doesnt pay for Quote
