still waiting on car accident 31 oct as the other party has,nt even reported it yet to his insurance can,t contact him by phone nor letter his company has tried also his company said can,t proceed with claim til policy holder is contacted i only have tpft my legal team can,t issue court proceeding till 3 months are up surely this can,t be right that i lose out because policy holder can,t be contacted

I had a similar issue when someone reversed into my previous car a few years back, although I had comprehensive insurance so I was able to get the estimate and repair work organised before the other driver notified her insurers. You should press your insurance company to contact the other person;s insurers and tell them that their insured has had an accident and failed to notify them. May be worth asking your insurers if small claims court action can be started against the other driver... in fact maybe your insurers should write to the other driver to claim, and then they will have to notify their insurers unless they want to end up in court.

you would not guess whats happening now i found out 2 days ago(it,s took him 6 weeks to contact his insurance)he,s now saying his van was stolen so the so say thief stopped gave out right phone number and right name to me and then drove off

Let the insurance companies sort it out - if he says that the vehcile was stolen then he must have reported it to the police and obtained a 'crime reference number'. So his insurance company would have been advised by him, if he is telling the truth.

Ivor has already given you top-class advise, keep on your insurance company to pursue this without you having to bear any costs.

got call from police today the bloke fully insured and the van has not been reported stolen to them great i though so told my legal team and they are still saying the other party insurance will not pay and we still need to prove it was,nt stolen what do i need to do to prove this

surely its upto him to prove it was stolen not you to prove it wasnt :blink:

I always go fully comp for these very reasons, had an accident 20 years ago & it took 1 year to sort out as I was 3rd party only & had to have my own solicitor as insurance didn't really want to know same as you, last month a young lad on a scooter decided to throw his bike under my bumper & did 2k damage, Direct Line couldn't do enough for me & I have the leagal team on my side for

i agree with silver mk2,when i had an accident in 1990,it took 6 months to sort out and i was told that was them being QUICK,and the reason it was quick was i needed 1300 quids worth of dental work done,and that was with legal fee's cover since then i always have gone fully comp(with the main car)and always with legal cover with out it insurance companys will drag there heels for ever.

 

if you havnt got legal cover on your car insurance have a check to see if you might have it with your household insurance?if so give them a call.

hello

still no joy with accident his insurance still saying that their client saying it was stolen refusing to pay out so went back to police to ask for proof that it was,nt reported stolen but they are saying the person who told me that it was,nt reported stolen should have not told me that and if insurer want to know they will have to contact them i told the other insurance that and they still not iinterested

 

i also rang witness works adderess they sent him some documents he can,t believe whats happening as he said as he went pass he saw the bloke playing with the sat nav

 

in case of a another accident what are you suppose to do in a accident like this what proof do you need it,s weird that police were their but because no one was injured they were not interested(so if i was injured this would not be a issue)police did,nt write anything down can,t find them because was told could be any police just going passed at the time

i wonder if the insurance ombudsman can help?just a thought whether they can help out in any way,or point you in the right direction.

still

waiting on my claim my legal team seem to be usless they have asked for a crime refence number that was in jan 08 and it seems they can,t produce one yet

all they have done is asked to see a copy of his driving licensce and telling them he was a small courier for which his insurance says he was not(i,ll can,t remember want the bloke looks like 10 months ago)and they are saying still not enough evendence to take it to court
