Anyway..i think doubling the points is a tad extreme..maybe increasing it by one point..but 3??!!...that would mean a newly qualified driver would lose his licence if he genuinely did not know who was driving the vehicle at the time...i think the rate of people who will lose their licence will go up. But you have to admit that quite a few peeps will use that clause to get out of a fine/points when caught speeding. I think..if a camera cannot prove who was driving, then it should be dropped/speed awareness course offered in lieu of points...but also i think that the vehicle owner should be responsable for any fines/points no matter who was speeding as it is his property and as such should ensure that whoever drives it should drive it responsably...... Was I imagining it? I think it must be very rare that anyone genuinely doesnt know or can't find out who is driving their car at any point in time. The 6 point threat is just to tell people to stop pulling DVLA's plonker. IIRC by 2010 all new cars will be fitted with black box recorders under proposed EU legislation. mumof4 Posted September 23, 2007 Report Posted September 23, 2007 when you pass your test, you have 2 years probation..get 6 points in that time and you will lose your licence and will have to reapply for a provisional and retake your test again...My two years is up in march...As far as i know it is irrespective of age.you can be 17 or 70 and still have 2 years from the date you passed. Technically this would be classed as "driving otherwise than in accordance with a licence".Would never stand up in court, they could not prove who was driving it and would be very unlikely to pursue it. I doubt they would even bother checking."As it stands if you name the driver and they deny it then you get done for "failing to provide the information as to who was driving".The responsibility is on the keeper of the vehicle to name the driver and provide proof if required....yep I thought this was for the police and courts, as it is in every other crime under English Law. A true example, The police show you a photograph of your car exceeding a speed limit. ( it is assumed you had not previously reported the car as stolen ).The driver is clearly visible and is obviously not you, ( different race, sex etc ).Can you name the driver....no....then you get prosecuted for "failing to provide the information as to who was driving".Its that simple. gregers Posted September 23, 2007 Report Posted September 23, 2007 i think the reason why governments in general keep shafting us motorists is because of the same old chestnut to do with green issues,they know dam well we will never give our cars up(and they bloody know it)so they keep bringing in these sort of things so it will come down to the individual to give there vehicle up(through totting up),so there going to force us through these new laws and get huge amounts of dosh in the process,but they keep forgetting that most of the voters are car drivers and its about time they realized that if they keep pissing us off then we will act accordingly. wonder how long it will take them to tax everyone who will end up using public transport :rolleyes: because theyve made owning and running a car an expensive exercise,coz lets face it us motorists give something in the reason of 7billion pounds a year in taxation,theyve got to get it from somewhere!!!!!
