You cheeky bugger! ;) :) :D ..yesss he knew..well i had to explain where the car ramps came from.lol

 

 

anyway..heres the test drive..

 

On start up a nice blue cloud appeared from behind but that was the only time it appeared, no knocking or tapping noises at all...exhaust sounded loud from the front, but on checking it when the drive was over it was a brand new exhaust.She handles smooth but there is a lot of wind noise..maybe i noticed it more as im used to driving so high up!.

 

The clutch pedal goes right to the floor, again maybe im not used to having to stretch my leg that far as the floor is raised in the Galaxy.....

 

She does have an oil leak which they are going to sort out after they have MOT her..i am also getting the cambelt changed even though it was last changed at 57k miles in 2002 and she is now on 98k miles!.

 

Otherwise..i cant fault her!!..i checked suspension, brakes, clutch, chasis, trim, seals, floor, handbrake,..all seems fine!

 

soo..fingers crossed the MOT goes well and nothing major appears on it!

 

have i bought a bargain??..

blue smoke on start up ...... mmmmm ...it's not burning oil is it? Did you notice any blue clouds looking through the rear view mirror specifically when the engines running on when you slow down from speed and take your foot off the gas? The way of checking is to rev the nuts off it when its hot and look to see whats coming out of the exhaust. Blue smoke .....no thanks. Edited by Bleeno

According to the members on the VVOC, blue smoke on start up is not uncommon as i checked and it was the only time......the oil leak is easily recitied.Needs a new rocker cover gasket wqhich they are going to replace.

There were no warning lights on the dash at all whilst driving..though i must admit i was concentrating on the gears and the clutch.....

Blue smoke on start up - leak on rocker cover gasket - been there....done that..(passat)....valve stems worn probably due lack of oil changes. The leak will come back, its due to pressure in the crankcase building up from the valve guide wear.

 

Best to get someone to follow you and observe the exhaust on the overrun and subsequent pickup - thats when the blue smoke will be obvious (you'll be too busy negoiting the roundabout to see it). Depending on the severity, it may already be down to 1 litre of oil per 200 miles. Ask him, "Honestly how much oil does it use? And can I have my money back if its more than 1 litre per 1000 miles? (In writing)"

I will ring him tomoz and ask about the valve stems..though i have no idea what they are...considering her age..and her milaege..i was expecting more to be wrong with her..

 

If i could keep the Gal..i would.But i cant.The Gal has an oil leak and has had it for some time and it is gradually getting worse.I cant afford to get everything repaired on her that needs doing even if at the hearing they would let me keep her and by some miracle wipe out the remainder of the balance oweing.I try my best on her..keeping her running..but some things are beyond me...the gals engine is covered in oil from the rocker cover down.The front bumper needs redoing as some pillock took it off the other day and it is currently tied on with rope....she needs a new tyre.....i have done my damndest with that car and i wish to hell i didnt have to let her go...but i have to be realistic..a single parent..4 kids..limited income..bills to pay....i have to let her go!.i dont want to but i have no choice...maybe if i had the 4k to pay her off..i would keep her..but i dont..and i cant raise it so i have no choice as i cant make the repayments on her and run/insure her and feed the kids.

 

The vectra yes its smaller..older..has a couple of problems....but is a hell of a lot lower on insurance..will be paid off so she is mine....i have asked the man at the garage to check her over completely..and if he finds something wrong that isnt covered in the MOT he will let me know..Yes i paid a deposit for her...yes she is so much diff to the Gal....Lower insurance group...if i bought a MKI..for around 1k..whose to say that wouldnt fall apart?..

 

I thought long and hard over whether to keep the gal and fight for her..but i had to be hard and realistic...In an ideal world..id have the money to pay her off..but believe me..i dont.

You never know at the hearing they may wipe out some of the debt as they are insured anyway to a degree cant remember if it is the capital or the interest though.

 

I have heard of people getting 45% knocked off the bill, what they will look at is the value they can get from the car in auction to recover the amount, they will usually say 30 - 40% of the highest book value, this is all dependent on the county though.

 

The underlying factor is whos name is the agreement in etc, etc. They may see it as not being viable to persue the money through sale and offer you another alternative, i.e. payment over a longer term, If it goes CCJ I am sure they have to freeze interest but don't quote me.

 

You could also start proceedings for an administration order where you could keep the car but all your bills would be taken into account and a small amount paid monthly, But that would be an absolute last resort if, you had a lot of outstanding bills, and not just a car that was not your fault in first place.

The Finance agreement is in his name...i am the registered keeper and i have possession of it.

 

I already have an IVA which i had to have when he got one .This will go against me at the hearing.The car cost 13.5k..paid off is 16.5k..outstanding balance isover 6.5k.to settle will cost 4k.

 

For me to attend the hearing and fight for the gal, i have to have his authority..the solicitor already knows that i have the car.He will give his authority..as he believes i wont win and he doesnt care either way..and i believe i wont win.He refuses to pay anymore on a car that he does not use or have.

 

sorry..info overload i know..but im very tired and had a scare with 3 of 4 today.

I take it you mean "Individual Voluntary Arrangement" between you and he?

 

Depends on the wording but possesion is 9/10 the law, its a civil matter not a criminal so if the agreement is between him and the finance company then they should persue him and not you.

 

No matter what the circumstances at the time of the finance agreement he was the one that purchased the car not you and therefore it is his responsibility financially.

 

We can all at the end of the day buy stuff on finance and after a couple of years say we don't want it and stop paying. The financial obligation is still there and it is very rare that they will take the goods back as colateral they will persue a CCJ instead, since the agreement is not in your name they cannot persue you no matter what.

 

If the car was purchased on one of the newer schemes like "yes car credit" then it is secured on the vehicle but the agreements are full of holes.

 

At the end of the day no matter what the arrangement between you and he it has nothing to do with the arrangement between him and the finance company, take legal proceedings agains him which will then interupt any other legal proceedings against the car.

How 3 of 4...is she ok ?

 

3 of 4 is ok...two teachers collared me after school..in the meantime she legged it out of the school grounds..she was halfway home when i found her after the school and the immediate area had been searched by myself, the staff of the school and a couple of mums.....she had wanted to go to a friends house..to say i was scared witless is an understatement and i scared her witless when i pulled to a stop in the middle of a busy round and screamed at her not to move and ran over to her.

Glen...the IVA is with a company..i dont really want to say any more on open forum , he is being chased financially for the car..but i was fighting it as i got him to give me authority to do so.

Thought id better add..as ive been asked a few times....noooooooooooo..i wont be leaving here..stuck with me i'm afraid. ;) :)

have you thought about maybe selling the Gal to a trader or private. You may get enough to pay off the 4K owing and have a bit in your pocket after depending on whats its worth.

 

Just a thought.

I cant hun as it isnt HPI clear...you are not supposed to sell a car that you are still paying finance one...Its not worth what is owed on it in the state it is in.
