Guest Cepheus Posted December 29, 2006 Report Posted December 29, 2006 No need for the 2 letters really. http://news.bbc.co.uk/1/shared/bsp/hi/pdfs...k_estimated.pdf Download this document, copy it into word, amend the bits that need amending and send it off special delivery. Even if you only have a few months of bank statements you can estimate the charges pro rata over the last 6 years. Part of that letter then asks them to either agree or disagree with the amount you estimate. If they disagree with your estimate then they have to prove the amount that they have actually charged you. Kills both birds with one stone this way. Well our bank had until 28th to reply to us and we haven't heard anything. Wife is going to call them today to see if it's being dealt with. Suppose we should allow a couple of extra days due to the amount of bank holidays we've had recently? Will update when we know any more. Quote
Bigjeeze Posted December 29, 2006 Report Posted December 29, 2006 When you get your money, make sure you save it to pay the banking charges the Banks are going to levy to get this lot back. You will soon be paying for having an account and each & every debit etc - just like the good old days - You can't rob a bank and expect to get a way with it you know!! (unless you're a bank of course) Quote

wonkydog Posted December 29, 2006 Report Posted December 29, 2006 Hi all, just got in from work to find a reply from the bank (been called in to work for the last three days and will be in for the weekend as well - HM forces for you!) Here is what it says - Thank you for getting in touch with us. I am sorry you are unhappy about your account charges.Like any business, we do make a charge for some of our extra services. When customers don't have enough in their accounts to cover a payment, this always means extra work - and it has to happen very quickly. We have to agree to make the payment by setting up or increasing an overdraft, or tell customers we can't agree it. We feel it's fair to charge for this service.Of course it's only fair too, that we're completely open about any charged-for services before you take them up. That's why we take care to give every new customer the latest guide to our charges. You can also get up-to-date details about fees and borrowing rates at all our branches, through our helpline and on our website.Just as importantly, we do everything we can to help our customers avoid these charges altogether. I'm sure you'll know how easy it is to keep a running check on how much is in your account. You're free to get an up-to-date balance at any of our cash machines, over the phone, on line and by weekly text to your mobile. If you know a payment is going to take you over the limit we've agreed, you're welcome to see if we can raise it - and we can usually give you an answer straight away. Again we can do that for you by phone, on line or at any of our branches.I do hope you can see that we make our charging system as fair as possible - and why I can't agree to cancel your charges. Please let me know if there is anything else I can do. If we cannot come to an agreed solution after this I will help you refer your complaint to the Financial Ombudsman Service for independent advice. If you are happy with the way I have dealt with your complaint, there is no need to reply to my letter. If I have not heard back from you by the 17/02/2007, I will close my file, though I will be happy to reopen it should you come back at any point afterwards. Please give me a call if it would help to talk through anything in my letter.Yours sincerely Well, on any other day I might have said "Oh well, tried my best" and given up. They will get the full 14 days, then I will draft a second letter informing them of my initiation of court proceedings. "I do hope you can see that we make our charging system as fair as possible - and why I can't agree to cancel your charges." Fine, then get your supervisor.Bring it on.If I fight and win, I winIf I fight and loose, at least I fought.Watch this space. Quote

Guest Cepheus Posted January 10, 2007 Report Posted January 10, 2007 Had a letter back from my bank asking me to detail all of the charges that I had proof of to prove my workings out. I had to estimate the charges as I don't have the last 6 years bank statements. Might be advisable for other people estimating their charges to list the ones they have proof for and include them in the initial letter. Saves the bank stalling for time later on! At least it isn't a straight out NO at this point!!! Quote

Case needs to be re-started - forgot to sign the form! Doh! (Lady on the desk didn't spot this either) Quote

NikpV Posted January 21, 2007 Report Posted January 21, 2007 they used to be different from banks but legislation was brought into allow them to be banks (thatcher I think) so the same rules should apply - There was a specific distinction but I cant remember what it is but those which have current accounts are classedas banks IIRC Quote
mumof4 Posted January 21, 2007 Report Posted January 21, 2007 The account i have with them is a flex account/current account..Hmmm.....Fight it is then.. Quote
