just been watching a very interesting program on bbc2 dont know how many of you were watching but it was on about banks charging every time you go over drawn or cheques or direct debits aint paid on time it was also telling you how to claim these charges back for the last 6 years if anyones interested heres the link

This can apparently be done successfully, as a mate of mine recently claimed back over

according to the programm the bank wont even go to court because they cant justify the charges someone has got back over

We read this on the BBC site and will be digging out the bank statements later today and trying to claim any charges back. We had a situation about 4 years ago where my December wage was paid into the bank late which resulted in 12 direct debits being refused. We got charged

unfortunately having been with the same major Hong-Kong/Shanghai based Banking Corporation (without directly naming names) for 30 years - they own me no money : ( so no xmas bonus there then) :D

Soooo...i live in england..but my branch is in scotland....so..do i just follow the instructions?...be a bit difficult if i have to file a claim with the sherrifs court!! :D

Many thanks for bringing this to our attention Teresa. We also had an argument with a leading telephone bank (that may have a conection with Hong Kong). After a long battle I only succeeded in getting a partial refund, so they'll be getting a letter from me shortly.

my prob is i aint got a bank account no more but ill be going into it in the next few days to see how long they keep em for and to get copies covering last 6 yrs business and current account

Depends under which county's laws you signed your banking agreement I would guess.

 

However, the Unfair Terms in Consumer Contracts law stems from an EU directive, so Scottish based banks would still fall foul of this.

I have sent today, by recorded delivery, the pre-formatted letter available from the BBC website.

 

All I had to do was enter my details in the relavent places. Dug out (on line) the statements for the last 4 years to highlight the charges and included this info with the letter.

 

If you dont have the full 6 years worth of statements you can estimate the rest by following the instructions on the website.

 

I will let you know what happens as I want my money back! :16:

 

Not letting you know how much I have been charged :D , but if I get it all back or they offer a settlement figure anywhere near, it will be a very nice sum (four figures) :D

 

They will, apparently sometimes close your account after settling. So there is a warning to have another bank account just in case.

Haven't managed to work out yet whether this can apply to business accounts or not - some info seems to say not ??

I am with Nationwide....and they are brilliant....very helpful...and i have found that they will do what they can to help..though i do find that the service differs from branch to branch..

Excellent,,,,,,,,,, letter will be sent tomorrow, one thing though it says that no bank has defended itself in court, with the millions of letters its going to receive,,,,,, they may start now!!!!!!!!!!!!!!!!!!!!!!!! Edited by bigdaddy

My letter was sent off special delivery yesterday and was for a 4 figure estimated sum also. (Divorces and self employment over the last 6 years sometimes has that effect!!) Will keep you all updated once I've uncrossed my fingers :lol:

wonder about moving to somewhere like nat west ? Any opinions??

 

I've got an account with NatWest and never had any problems with it or them.

 

However, we tried opening a junior savings account for my step-son a few weeks ago and they made it as difficult as they possibly could for us. His surname is different to that that of my wife (his mum) and has never been the same as hers. Because of this (and them sticking strictly to Bank of England guidelines) we had to revist the local branch 4 times with varying amounts and types of ID for both my wife and my step-son before they would open the account for him! Sad to say, I worked in a bank many years ago. The attitude was the same as an business, 'screw' the customer and make as much money from them as possible, only if they complained would a refund of charges be 'entertained' i.e. a long and boring interview with the Branch Manger explaining exactly why the charges were both relevant and justified. Usually resulted in slit wrists and very great mess to clear up 'cos manager could bore the pants off of anything living - or not. ;)

Checked with the Post office online, and the bank (loLdysBTS) has received my letter. Just waiting for their reply now.

 

Off topic for a mo, has anyone been recording Terry Pratchett's "Hogfather" on DVD? I have the first episode from Sunday but missed last nights finale. Can anyone help? I will send a blank disc to anyone who could burn me a copy. Thanks.

No reply as yet. They have until the 1st Jan. Have been doing a bit of research, the next step is to is start court proceedings and await the reply. Their choice - defend (with costs), ignore (I win by default) or, make me an offer or refund in full.

 

Banks seem to keep things until the last minute of deadlines and try to fob you off. NO CHANCE this time.

 

I will have to pay to start proceedings (fee depends on claim amount) but this looks to be around
